Welcome to PAW BY FOUR. The terms “we”, “us” and “our” refer to PAW BY FOUR, a business based in Enniskillen, Northern Ireland, United Kingdom.

PAW BY FOUR LIMITED operates this store and website including, all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). PAW BY FOUR is powered by Shopify, which enables us to provide the Services to you. Our products are also available via Etsy and Payhip; purchases made through those platforms are subject to their respective terms of service in addition to our own policies.

These Terms of Service (“Terms”) describe your rights and responsibilities when you use the Services. Please read them carefully. They include important information about your legal rights, warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service, our Privacy Policy, our Shipping Policy and our Refunds Policy. If you do not agree to these Terms or our other Policies, you should not use or access our Services.

These Terms do not affect your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

SECTION 2 — ACCESS AND ACCOUNT 

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age or that you have the consent of a parent or guardian to use the Services.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 3 — OUR PRODUCTS 

We have made every effort to provide an accurate representation of our products and services in our online store. However, please note that colours or product appearance may differ from how they appear on your screen due to device settings and display configuration. This does not affect your statutory rights.

All physical products sold by PAW BY FOUR are provided in accordance with the Consumer Rights Act 2015 and must be of satisfactory quality, fit for purpose and as described. If a product does not meet these standards, you have statutory rights to a repair, replacement or refund.

All digital products, including downloadable guides and resources, are also subject to the Consumer Rights Act 2015 standards for digital content. Digital content must be of satisfactory quality, fit for purpose and as described. If digital content is faulty, you are entitled to a repair or replacement and where this is not possible, a price reduction or refund.

All product descriptions are subject to change at any time. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction.

SECTION 4 — YOUR RIGHT TO CANCEL (COOLING-OFF PERIOD) 

As a consumer purchasing online, you have the right to cancel your order within 14 calendar days of receiving your goods, without giving any reason. This is your statutory cooling-off right under the Consumer Contracts Regulations 2013.

Physical Products

To exercise your right to cancel a physical product order, you must inform us of your decision to cancel within 14 days of receiving the goods. You may do this by contacting us at support@pawbyfour.com. You will then be required to return the goods to us within 14 days of notifying us of your cancellation. We will issue a full refund of the purchase price, including standard delivery costs within 14 days of receiving the returned goods or proof of return. Return postage costs are your responsibility unless the goods are faulty or not as described.

Digital Products and Downloads

For digital products, including downloadable guides and resources, your right to cancel ends once you have downloaded or streamed the content, provided you gave your explicit prior consent for delivery to begin before the end of the cancellation period and acknowledged that your right to cancel would be lost upon download.

If you have not yet downloaded or accessed the digital content, you retain the right to cancel within 14 days of purchase.

Exceptions to the Right to Cancel

The right to cancel does not apply to: 

(a) goods made to your specification or clearly personalised; 

(b) goods which are liable to deteriorate or expire rapidly; or 

(c) digital content where delivery has begun with your consent and acknowledgement as described above.

SECTION 5 — ORDERS

When you place an order, you are making an offer to purchase. PAW BY FOUR reserves the right to accept or decline your order for any reason. Your order is not accepted until PAW BY FOUR confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. In the event that we do not accept your order, amend your order or cancel your order, we will notify you by email to the address provided at the time of purchase.

Your statutory rights to return or exchange goods are governed by the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, as described in these Terms and in our Refund Policy. These statutory rights are in addition to and not in place of, any separate returns policy we may offer.

Products are intended for your personal or household use and not for commercial resale or export.

SECTION 6 — PRICES AND BILLING 

Prices displayed on our website are in pounds sterling (GBP). All prices are inclusive of any applicable UK taxes only unless otherwise clearly stated. Delivery charges will be clearly displayed before you complete your purchase. 

Where delivery of an order is outside the UK, local purchase taxes and import duties may be payable. Unfortunately, we are unable to provide a value for those charges on purchase and you are advised to consult the relevant tax authorities and/or import authorities to determine what they might be.

The price charged for a product will be the price in effect at the time the order is placed, as set out in your order confirmation email. Prices are subject to change without notice, but any change will not affect orders already accepted.

You agree to provide current, complete and accurate payment information for all purchases. You represent and warrant that you are authorised to use the payment method provided and that charges incurred will be honoured.

SECTION 7 — SHIPPING AND DELIVERY 

We aim to dispatch physical orders within the timeframe stated on the product listing. Estimated delivery times are provided at checkout and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing or circumstances outside our reasonable control.

However, if a delivery date was agreed at the time of purchase and we fail to deliver within that timeframe, you may be entitled to cancel your order and receive a full refund in accordance with your rights under the Consumer Rights Act 2015. Please contact us at support@pawbyfour.com if your order has not arrived within the expected timeframe.

Risk of loss and damage passes to you once the goods are delivered to the address specified in your order.

Digital products are delivered electronically by email or download link following payment confirmation. Delivery of digital products is typically immediate or within a short period of payment processing.

SECTION 8 — INTELLECTUAL PROPERTY 

Our Services, including all trademarks, brand assets, text, images, graphics, product reviews, video, audio and the design and arrangement thereof, are owned by PAW BY FOUR or its licensors and are protected by UK and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent.

PAW BY FOUR’s names, logos, product and service names, designs and slogans are the intellectual property of PAW BY FOUR. You must not use these without prior written permission. All other names, logos and marks on the Services are the property of their respective owners.

SECTION 9 — REVIEWS AND FEEDBACK 

We welcome genuine feedback, reviews and suggestions from customers. By submitting a review or feedback, you confirm that it reflects your genuine experience and that you are the person who purchased or used the product concerned.

In accordance with the Digital Markets, Competition and Consumers Act 2024, we do not commission, submit or host fake reviews. Where reviews are moderated, we will disclose this fact. We reserve the right to remove reviews that we reasonably determine to be false, misleading, abusive or in breach of these Terms.

By submitting feedback, ideas or suggestions to us, you grant us a non-exclusive, perpetual, royalty-free licence to use such content for the purposes of operating and improving our Services. You represent that you own or have the necessary rights to any content you submit and that it does not infringe the rights of any third party.

SECTION 10 — OPTIONAL TOOLS

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have control over. We provide access to such tools “as is” and “as available” without any warranties of any kind. We shall have no liability arising from or relating to your use of optional third party tools. Any use of such tools is entirely at your own risk and discretion.

The Services may contain links to websites or online platforms operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third party materials or websites. If you access third party sites, you do so at your own risk. We are not liable for any harm or damages related to your access to third party websites or your purchase or use of any products or services available on such sites. Complaints or concerns regarding third party products and services should be directed to the relevant third party.

SECTION 12 — RELATIONSHIP WITH SHOPIFY

PAW BY FOUR is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with PAW BY FOUR. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and PAW BY FOUR, including any injury, damage or loss resulting from purchased products and services.

SECTION 13 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, which is available on our website. By using the Services, you acknowledge that you have read and understood our Privacy Policy. Certain personal information may also be subject to Shopify’s Privacy Policy, available at www.shopify.com/legal/privacy.

SECTION 14 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. This does not affect orders already accepted, for which the price at the time of acceptance applies.

SECTION 15 — PROHIBITED USES 

You may access and use the Services for lawful purposes only. You may not access or use the Services: 

(a) for any unlawful or malicious purpose; 

(b) in violation of any UK, international or other applicable laws or regulations; 

(c) to infringe upon our intellectual property rights or those of any third party; 

(d) to harass, abuse, harm, defame or intimidate any person; 

(e) to transmit false or misleading information; 

(f) to send unsolicited commercial communications including spam; or 

(g) to engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Services.

You also agree not to: 

(a) upload or transmit viruses or malicious code; 

(b) reproduce, duplicate, copy, extract, sell or exploit any portion of the Services without our consent; 

(c) collect or track the personal information of others; or 

(d) use automated tools, scrapers, bots or AI agents to access the Services except as permitted under Section 16 below.

We reserve the right to suspend, disable or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

This section applies if you use, allow, enable or cause the deployment of an automated agent to access, use or interact with the Services. “Agent” means any software or service that takes autonomous or semi-autonomous action on behalf of any person or entity without direct human supervision.

No Agent may access, use or interact with the Services unless it: 

(a) clearly identifies itself as an Agent in all HTTP/HTTPS requests; 

(b) does not conceal or obfuscate that access or interactions are from an Agent; 

(c) responds truthfully to any prompt seeking to determine whether interactions are from a human or automated system; and 

(d) does not circumvent any measure intended to block, limit or control Agent access to the Services.

We may limit, including by technical measures, whether and how any Agent accesses or interacts with the Services. No Agent may access the Services if we have requested that it refrain from doing so.

SECTION 17 — TERMINATION

We may terminate these Terms or your access to the Services at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. 

Termination does not affect any statutory rights you hold as a consumer under UK law.

The following sections will continue to apply following any termination: Intellectual Property, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law and Privacy Policy.

SECTION 18 — DISCLAIMER OF WARRANTIES 

The information presented on or through the Services is made available for general information purposes. While we take care to ensure accuracy, we do not warrant the completeness or accuracy of this information for any particular purpose.

Nothing in these Terms excludes or limits our liability for:

(a) death or personal injury caused by our negligence; 

(b) fraud or fraudulent misrepresentation; 

(c) any breach of the terms implied by the Consumer Rights Act 2015 in respect of goods or digital content supplied to consumers, including that goods will be of satisfactory quality, fit for purpose and match their description; 

(d) any liability arising under the Consumer Protection Act 1987 in respect of defective products; 

(e) any other liability that cannot be excluded or limited under applicable UK law.

Subject to the above and to the fullest extent permitted by applicable law, we exclude all implied warranties, representations and conditions not expressly stated in these Terms. This exclusion does not affect your statutory rights as a consumer.

SECTION 19 — LIMITATION OF LIABILITY

Subject to the limitations in Section 18 above and to the fullest extent permitted by applicable UK law, our total liability to you for any claim arising out of or in connection with these Terms or your use of the Services shall not exceed the amount you paid to us for the product or service giving rise to the claim.

We shall not be liable for any indirect, incidental or consequential loss or damage arising from your use of the Services, except where such loss is a foreseeable result of a breach of these Terms or applicable law.

Nothing in this section affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable UK consumer protection legislation.

SECTION 20 — INDEMNIFICATION 

You agree to indemnify and hold harmless PAW BY FOUR, our affiliates, officers, employees, agents and service providers from any losses, damages, liabilities or claims (including reasonable legal costs) arising directly from: 

(a) your breach of these Terms; 

(b) your violation of applicable law; or 

(c) your wilful misuse of the Services.

This indemnification does not apply to claims arising from our own negligence, breach of statutory duty or breach of these Terms.

SECTION 21 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severed from these Terms to the minimum extent necessary and the remaining provisions shall continue in full force and effect.

SECTION 22 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding your use of the Services and supersede any prior agreements or communications.

SECTION 23 — ASSIGNMENT

You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. We may transfer, assign or delegate these Terms and our rights and obligations without consent, provided that any such assignment does not diminish your rights under these Terms or applicable law.

SECTION 24 — GOVERNING LAW.

These Terms of Service are governed by and construed in accordance with the laws of Northern Ireland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Northern Ireland, except that nothing in this clause prevents you from bringing a claim in the courts of your own place of residence if you are a consumer.

Nothing in these Terms affects your rights as a consumer to bring a claim in the courts of the country in which you are resident.

SECTION 25 — ALTERNATIVE DISPUTE RESOLUTION 

If you have a complaint about our products or services, please contact us in the first instance at support@pawbyfour.com. We aim to resolve all complaints promptly and fairly.

If we are unable to resolve your complaint to your satisfaction, you may be able to refer the matter to an Alternative Dispute Resolution (ADR) provider. Further information on ADR is available from the Citizens Advice Bureau at www.citizensadvice.org.uk.

The headings used in these Terms are included for convenience only and will not affect their interpretation.

SECTION 27 — CHANGES TO TERMS OF SERVICE

We reserve the right to update or change these Terms at any time. The most current version will always be available on this page. We will notify you of any material changes by email or by a notice on our website, in accordance with applicable law. Your continued use of the Services following notification of changes constitutes your acceptance of the updated Terms.
